Terms and Conditions

Sign Up Now, Inc (SUN) provides sign installation and removal services in accordance with requests from real estate agents and brokers. Upon such request for sign service, the agent agrees to the following terms and conditions: The word “agent” as used herein shall mean to include the agent, any agent’s assistant, and/or any person acting on behalf of the agent.

Sign Installation Request

The agent shall provide complete and correct information on the order form.

The agent, prior to each request for any sign service, shall obtain permission for SUN to enter upon the specified property so as to complete the requested service.

The agent, prior to each request for any sign installation service, shall verify from the appropriate property owner, and/or Home Owner Association, that signs are permitted at the specified property. The agent, prior to each request for any sign installation, shall verify that there is a viable and visible location for the sign post.

The agent, prior to each request for any sign installation at vacant lots, land, or new construction sites shall clearly mark, stake, or flag the desired sign location(s).

Spot-specific Sign Location

The agent, upon requesting a spot-specific sign location shall clearly mark, stake or flag the desired sign location. The agent is responsible for verifying that the spot-specific location is a safe and legal sign location. Without the agent’s request for a spot-specific sign installation, the SUN installer’s judgment and “best guess” shall suffice to complete the sign installation. The agent agrees to properly submit a subsequent sign request form if the installed sign is to be later moved and re-installed to a desired location;… “Service Charges” shall apply.

Neither the agent, property owner, tenant, nor any person other than SUN is authorized to remove or install the sign post.

Sign Removal Requests

The agent agrees to properly submit requests for sign removal no later than 2 business days prior to the close of escrow or expiration of the listing period.

The agent agrees to properly submit requests for sign removal immediately upon the loss, cancellation, withdrawal, or the assignment of the listing to another person. The agent shall not permit another person to use or borrow the existing sign post.

If the agent fails to properly submit the sign removal order resulting in the loss or damage to the sign post and/or brochure box, “Lost Charges” shall apply. The agent agrees to assure that the sign post is not located in any inaccessible garage, storage shed, barn, basement, fenced area, alleyway, etc. SUN cannot be expected to enter any inaccessible or inconvenient area to retrieve the sign post. The agent agrees to assist SUN as reasonably necessary to make sign retrieval possible. If the sign post is not retrievable, “Lost Charges” shall apply.

Underground Systems and Utilities

The agent, upon ordering any sign installation, shall provide notification (on the order form) regarding any concerns for cable lines, phone lines, sprinklers, “invisible” pet fences, utilities, sump pump lines, or other underground system.

The agent or property owner shall clearly mark, stake, or flag a desired safe and legal, spot-specific sign location so as to avoid encroachment or damage to any underground system. Without proper notification and a spot-specific marker, the SUN installer’s judgment and “best guess” shall suffice to complete the sign installation. SUN is not responsible for damage to any underground system.

Agent/Broker Contact Information

The agent shall provide updated and accurate contact information.

The agent, upon changing agencies, agrees to notify SUN immediately and request the sign removal accordingly. Or, upon changing agencies, the agent will properly submit a sign order form to request the appropriate “switch” of the agent’s sign panel;… a “Trip Charge” shall apply. Sign Relocations, Re-installations, and Repairs

The agent agrees to submit a sign order form for any request to relocate, reinstall, replace, or otherwise repair an existing signpost, panel, or brochure box. Whether the agent requests that SUN relocate an existing signpost to a better “spot”, install a new signpost, or reinstall an existing signpost, “Service Charges” shall apply. See Summary List for applicable “Service Charges”. If SUN has erred with respect to the requested sign location, Service Charges are waived. Also, repairs due to vandalism, tampering, mischief, extreme weather (high winds, heavy rains, storm, etc.) or unauthorized removal are subject to “Service Charges”.

Refusal / Unable to Install

The agent, prior to each request for any sign installation service, shall verify that the property owner and tenants (if any) are aware that a sign post is to be installed. If the SUN installer arrives at the specified address and the property owner or tenant refuses to permit the requested sign installation, a “Refusal Charge” shall apply. Trip Charge / Unable to Install

The agent, prior to each request for any sign installation service, shall verify that there is a viable, visible, and permissible location for the requested sign post. If the SUN installer arrives at the specified address and is unable to install the requested sign post due to an impervious surface (cement, asphalt, brick, etc.) or a hindrance (barking dog, high privacy fence, locked gate, high hedge or bushes, etc.) or Homeowner Association Restrictions or Easement, a “Trip Charge” shall apply. The agent, prior to each request for any sign installation service at vacant lots, land, or new construction sites shall clearly mark, stake, or flag the desired sign locations. If the SUN installer is unable to locate the vacant lot, land, or new construction site due to the lack of any clearly visible mark, stake, or flag, a “Trip Charge” shall apply.

Billing / Service Charges and Lost Charges

The agent agrees that applicable “Service Charges” and/or “Lost Charges” shall be automatically billed to the agent’s credit card. Or, at the option of SUN, applicable “Service Charges” and/or “Lost Charges” shall be invoiced to the agent. The agent further agrees that any such invoice is due and payable to SUN upon receipt.

Collection Costs

The agent agrees to reimburse SUN for any and all collection costs incurred by SUN as a result of agent’s past due amounts. Said collection costs shall include any Collection Company fees, Sheriff service fees, Court costs and filing fees, and Attorney Fees.
